this facility or activity:

Activity:	
To operate and maintain an existing combined wastewater collection system and 
an existing 0.72 million gallons per day wastewater treatment plant.  These 
facilities are to serve a population equivalent of approximately 7,200 persons 
in the Flatwoods-Canoe Run Public Service District, including the Town of 
Sutton and the Town of Gassaway, Buckeye, Skidmore Run, Chemical Town, Catholic 
Hill, and Buffalo areas of Braxton County and environs, and discharge treated 
wastewater through Outlet No. 001 to the Elk River, approximately 93.6 miles 
from its mouth, of the Kanawha River.  An antidegradation review has been 
conducted.  Tier 2 protection is afforded for all parameters of concern 
requiring that protection.  The agency made a determination that the activity 
will not cause significant degradation to the receiving stream. Also, to 
operate and maintain disposal systems, best management practices, and the nine 
minimum controls for the direct discharge of sanitary wastewater and storm 
water from Combined Sewer Overflow (CSO) Outlets C002-C006 and C008 to the Elk 
River.  These CSO Outlets are permitted to discharge only when the hydraulic 
capacity of the collection system is exceeded during wet weather events.  Tier 
1 protection shall be afforded the discharges from combined sewer overflow 
relief points C002-C006 and C008 through implementation of the Long-term 
Control Plan.  Also, to accept nondomestic wastewater from Central WV Refuse 
Landfill for subsequent treatment and disposal.  Also, to incorporate the 
requirements relative to Title 33, Series 2 of the West Virginia Legislative 
Rules for the processing and disposal of sewage sludge generated by the 
wastewater treatment plant, sewage sludge generated and/or processed at the 
permittee's facility shall be disposed at a landfill and land applied, provided 
that the sewage sludge shall not be applied in a manner that exceeds the 
agronomic or lifetime loading rates.  This land application site(s) meet all 
other regulatory standards and are identified as follows: Kenna Seal farm, 
located at 281 Facemine Drive, Sutton, WV; Jeffrey E. Smith farm, located at 
2188 Leatherwood Run, Frametown, WV; Bradley Meadows farm, located on Route 7/3 
at 387 Meadow Valley, Gassaway, WV; Garry Duffield farm, located at 1851 
Villanova Ridge Road, Duck, WV; Rodney Hickman farm, located at 701 North 3rd 
Street, Sutton, WV; John Bean farm, located at 764 Keeners Ridge Road, Birch 
River, WV; Donald Burroughs farm, located at 2424 Pickles Fork Road, Heaters, 
WV.

Implementation:
Compliance with the Combined Sewer Overflow requirements shall be attained 
through Administrative Order No. 6061, issued the 26th day of April 2007, and 
any amendments, thereto.

	On the basis of review of the application, the "Water Pollution 
Control Act (Chapter 22, Article 11-8(a))," and the "West Virginia Legislative 
Rules," the State of West Virginia will act on the above application.

	Any interested person may submit written comments on the draft permit 
and may request a public hearing by addressing such to the Director of the 
Division of Water and Waste Management within 30 days of the date of the public 
notice.  Such comments or requests should be addressed to:

	The public comment period begins October 10, 2017 and ends November 
09, 2017.

	Comments received within this period will be considered prior to 
acting on the permit application.  Correspondence should include the name, 
address and the telephone number of the writer and a concise statement of the 
nature of the issues raised.  The Director shall hold a public hearing whenever 
a finding is made, on the basis of requests, that there is a significant degree 
of public interest on issues relevant to the Draft Permit(s).  Interested 
persons may contact the public information office to obtain further information.

	The application, draft permit and any required fact sheet may be 
inspected, by appointment, at the Division of Water and Waste Management Public 
Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 
8:00 a.m. and 4:00 p.m. on business days.  Copies of the documents may be 
obtained from the Division at a nominal cost.
