APPLICATION FOR A WEST VIRGINIA NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM 
WATER POLLUTION CONTROL PERMIT

The following has applied for a WV NPDES Water Pollution Control Permit for 
this facility or activity:

OHIO RIVER

Activity:	
Operate and maintain treatment and disposal systems and best management 
practices for the direct discharge of treated process wastes, groundwater, and 
storm water through Outlet 006 into the Ohio River at approximate milepoint 
68.7, treated sanitary waste, untreated storm water, untreated non-contact 
cooling water, and untreated boiler blowdown through Outlet 004 into the Ohio 
River at approximately milepoint 68.85, and untreated drains from freeze 
protection lines for the river water through Outlets 008 and 009 into the Ohio 
River at approximately Milepoint 68.9.

Also to operate and maintain an intake system (Outlet 097) for the withdrawal 
of water from the Ohio River.

The permittee has been granted a variance for ammonia nitrogen at Outlet 006 in 
accordance with Section 301(g) of the Clean Water Act.  An antidegradation 
review has been conducted.  There are no new or expanded discharges in the 
reissuance of this permit.  Tier 1 protection shall be provided through 
compliance with the terms and conditions of the permit.

Business conducted:
Mountain State Carbon is a by-product recovery coke plant.

Implementation:
N/A

	On the basis of review of the application, the "Water Pollution 
Control Act (Chapter 22, Article 11-8(a))," and the "West Virginia Legislative 
Rules," the State of West Virginia will act on the above application.

	Any interested person may submit written comments on the draft permit 
and may request a public hearing by addressing such to the Director of the 
Division of Water and Waste Management within 30 days of the date of the public 
notice.  Such comments or requests should be addressed to:

	The public comment period begins October 13, 2017 and ends November 
12, 2017.

	Comments received within this period will be considered prior to 
acting on the permit application.  Correspondence should include the name, 
address and the telephone number of the writer and a concise statement of the 
nature of the issues raised.  The Director shall hold a public hearing whenever 
a finding is made, on the basis of requests, that there is a significant degree 
of public interest on issues relevant to the Draft Permit(s).  Interested 
persons may contact the public information office to obtain further information.

	The application, draft permit and any required fact sheet may be 
inspected, by appointment, at the Division of Water and Waste Management Public 
Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 
8:00 a.m. and 4:00 p.m. on business days.  Copies of the documents may be 
obtained from the Division at a nominal cost.
