APPLICATION FOR A WEST VIRGINIA NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM WATER POLLUTION CONTROL PERMIT Public Notice No.: L-137-17 Public Notice Date: December 07, 2017 Paper: The Journal The following has applied for a WV NPDES Water Pollution Control Permit for this facility or activity: Appl. No.: WV0023167 Applicant: MARTINSBURG, CITY OF PO BOX 828 MARTINSBURG, WV 25402 Location: MARTINSBURG, BERKELEY COUNTY Latitude: 39:27:05 Longitude: 77:57:14 Receiving Stream: Tuscarora Creek/Opequon Creek/Potomac River Activity: To operate and maintain an existing combined wastewater collection system and an existing 3.0 million gallons per day wastewater treatment plant. These facilities are to serve a population equivalent of approximately 40,000 persons in the City of Martinsburg, the Route 9 East Area of the Berkeley County Public Service Sewer District, and environs, and discharge treated wastewater through Outlet No. 001 to Tuscarora Creek, approximately 1.6 miles from its mouth, of Opequon Creek of the Potomac River. An antidegradation review has been conducted and Tier 1 protection is provided for the uses specified in Title 47, Series 2, Section 6 for Outlet No. 001. To operate and maintain disposal systems, best management practices, and the nine (9) minimum controls for the direct discharge of sanitary wastewater and storm water from Combined Sewer Overflow (CSO) Outlet No. C003, to Tuscarora Creek. This CSO Outlet is permitted to discharge only when the hydraulic capacity of the collection and/or treatment system is exceeded during wet weather events. Tier 1 protection shall be afforded for the wet weather discharges from combined sewer Outlet C003 through the implementation of the facility's CSO Long-term Control Plan (LTCP). Also, to allow the discharge of untreated storm water runoff through Outlet No. 002 to Tuscarora Creek. Compliance with the antidegradation requirements is attained through the implementation of Best Management Practices. To accept and treat nondomestic wastewater from the City of Martinsburg Big Springs Water Treatment Plant, City of Martinsburg Water Treatment Plant, City Hospital WVU East, and Enterprise Rent a Car. Also, to incorporate the requirements relative to Title 33, Series 2 of the West Virginia Legislative Rules for the processing and disposal of sewage sludge generated by the wastewater treatment plant. Sewage sludge generated and/or processed at the permittee's facility shall be disposed of at a sanitary landfill by placing the sewage sludge in the landfill cell. Business conducted: Municipality Implementation: Compliance with the Combined Sewer Overflow requirements shall be attained in accordance with the terms and conditions of Administrative Order No. 6331, issued the 27th day of December 2007, and any amendments, thereto. Compliance with certain other terms and conditions of the permit shall be attained in accordance with Administrative Order No. 8775 to be issued with the final permit. On the basis of review of the application, the "Water Pollution Control Act (Chapter 22, Article 11-8(a))," and the "West Virginia Legislative Rules," the State of West Virginia will act on the above application. Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Comments received within this period will be considered prior to acting on the permit application. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). The application, draft permit and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 8:00 a.m. and 4:00 p.m. on business days.
