APPLICATION FOR A WEST VIRGINIA NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM WATER POLLUTION CONTROL PERMIT Public Notice No.: L-101-18 Public Notice Date: August 27, 2018 Paper: Weirton Daily Times The following has applied for a WV NPDES Water Pollution Control Permit for this facility or activity: Appl. No.: WV0004626 Applicant: ERGON-WEST VIRGINIA, INC. 9995 OHIO RIVER BLVD PO BOX 356 NEWELL, WV 26050 Location: NEWELL, HANCOCK COUNTY Latitude: 40:36:39 Longitude: 80:37:51 Receiving Stream: OHIO RIVER Activity: Operate and maintain a treat and disposal system and best management practices for the direct discharge of treated industrial wastes, sanitary waste and storm water through Outlet 001 into the Ohio River in the vicinity of Mile Point 47.4. Also to operate and maintain a treat and disposal system and best management practices for the direct discharge of untreated cooling tower blowdown through Outlet 002 into the waters of the Ohio River at Mile Point 47.23. Also to operate and maintain a treat and disposal systems and best management practices for the direct discharge of untreated storm water through Outlets 003 and 004 into an unnamed tributary of Congo Run, a tributary of the Ohio River. Tier 1 protection is provided for the uses of public water supply, propagation and maintenance of fish and other aquatic life, water contact recreation, agricultural and wildlife, and water supply industrial, water transport, cooling and power. Business conducted: Refining of Appalachian crude oil to manufacture lube oils, gasoline and distillate fuels. Implementation: Compliance shall be attained through Administrative Order No. 8828. On the basis of review of the application, the "Water Pollution Control Act (Chapter 22, Article 11-8(a))," and the "West Virginia Legislative Rules," the State of West Virginia will act on the above application. Any interested person may submit written comments on the draft permit and may request a public hearing by addressing such to the Director of the Division of Water and Waste Management within 30 days of the date of the public notice. Comments received within this period will be considered prior to acting on the permit application. Correspondence should include the name, address and the telephone number of the writer and a concise statement of the nature of the issues raised. The Director shall hold a public hearing whenever a finding is made, on the basis of requests, that there is a significant degree of public interest on issues relevant to the Draft Permit(s). Interested persons may contact the public information office to obtain further information. The application, draft permit and any required fact sheet may be inspected, by appointment, at the Division of Water and Waste Management Public Information Office, at 601 57th Street SE, Charleston, WV 25304-2345, between 8:00 a.m. and 4:00 p.m. on business days. Copies of the documents may be obtained from the Division at a nominal cost.
