APPLICATION FOR WEST VIRGINIA SOLID WASTE FACILITY
PERMIT MAJOR MODIFICATION TO NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM 
(NPDES) PERMIT

The following has applied to the West Virginia Department of Environmental 
Protection 
for a major modification of a solid waste facility permit.

Applicant:	Lackawanna Transport Company
	Wetzel County Sanitary Landfill	
	Rt. 1, Box 156 A
	New Martinsville, WV  26155
		
Permit No.:	SWF-1021/WV0109185

Location:	The site can be reached by taking WV Route 2, just south of 
	New Martinsville, WV.  Proceed 1.8 miles on WV Route 180.
	Turn left on County Route 28/1, known as Cider Run Road.
	Proceed 1.5 miles on Route 28/1.  

Activity:	Commercial Sanitary Landfill

			
The applicant may receive a maximum of 9, 999 tons/month of the following types 
of waste:  
Solid waste as defined in W.Va. Code Chapter 22, Article 15 Section 2(31) and 
as listed in 33CSR1 Section 2.119..  Wastewater treatment plant solids, non-
hazardous industrial process solid wastes, and non-hazardous sludge will be 
accepted only after approval by the Division 
of Water and Waste Management.  Tires may be used in the landfill in accordance 
with W.Va. Code and 33CSR5.  Included in the types of authorized wastes are:  
residential, commercial, industrial, construction demolition debris, non-
hazardous industrial waste, institutional waste, autoclaved or sterilized 
waste, petroleum contaminated soil, compost and sludge.  
 
The waste stream for municipal solid waste and non-hazardous special waste will 
originate 
from Wetzel, Tyler and Marshall Counties of West Virginia; Pennsylvania, New 
York and 
New Jersey customers listed in the permit application.
		
The center of the site is 39? 36’ 14” N latitude and 80? 51’ 43” W longitude. 



Treated leachate water discharge points, Outlet 001 and Outlet 004, are located 
at
39° 37’ 43” N latitude and 80° 52’ 15” W longitude; it will discharge treated 
leachate  
to the Ohio River at mile point 129.

Storm water discharge point, Outlet 002, is located at 39° 36’ 07” N latitude 
and 
80° 52’ 03” W longitude; it will discharge untreated storm water into an unnamed
tributary of Peach Fork Creek, 0.38 miles from the mouth.  

Storm water discharge point, Outlet 003, is located at 39° 36’ 06” N latitude 
and 
80° 51’ 49” W longitude; it will discharge untreated storm water into an unnamed
tributary of Peach Fork Creek, 0.57 miles from the mouth.  

On the basis of review of the application, the Solid Waste Management Act, 
Chapter 22, Article 15, Section 5(b) and 5(c), and 33CSR1 West Virginia Solid 
Waste Management Rule, the state of West Virginia will act on the above 
application.
      	
Interested persons may submit written comments during the 30-day public comment 
period, which begins on August 21, 2019 and ends on September 20, 2019, to the

Comments received within this time period will be considered prior to any state 
action on the subject application.  Correspondence should include the name, 
address, and telephone number of the writer and a concise statement of the 
nature of the issues addressed.  

A public hearing may be held if the state identifies a significant degree of 
public interest 
on issues relevant to the permit application.  To obtain further information 
concerning the 
subject application, or to request a public hearing, interested persons may 
contact the Division 
of Water and Waste Management during the public comment period at the above 
address.

The draft permit will be on file for public review during the comment period at 
the DEP
