Notice of Comment Period West Virginia Department of Environmental Protection This mailing is to advise the public that we have received an application for reissuance of an Article 11/West Virginia National Pollutant Discharge Elimination permit WV0020834 for THE MARSHALL COUNTY COAL COMPANY , 46226 NATIONAL ROAD , SAINT CLAIRSVILLE, OH 43950, in order to maintain, monitor and operate Haulroads, Access Roads, Preparation/Cleaning Plant, Loadout Facility, Raw Coal Stockpile, Refuse Areas, Bathhouse/Sewage, Richmond Airshaft and Deep Mine in the Pittsburgh Seam of coal. Utilization of FGD sludge from FirstEnergy Bruce Mansfield Power Plant, Samis Fly Ash, Pleasant Fly Ash and material solidifier Crown 790 as a beneficial use to be placed within the limits of the coal refuse. The operation discharges treated water and storm water into Ben Run of Pennsylvania Fork and Cedar Run and Squirrel Alley and UT’s of Maggoty Run and UT of Left Fork/Left Fork and UT of Speakeasy Hollow and Seldom Seen Hollow and UT of Upper Bowman Run and UT of Lower Bowman Run/Lower Bowman Run and UT of Big Tribble Creek and Little Tribble Creek of Big Tribble Creek and UT of UT of Fish Creek/Fish Creek and Conner Run and Long Run and Coon Run and Graveyard Run and UT of Hog Run/Hog Run and Hot Hollow and an UT of Laurel Run/Laurel Run and French Run and Straight Run and UT of North Fork/North Fork of Grave Creek/Grave Creek, all of Upper Ohio River. The permit is located in Marshall County, Longitude 80° 48´ 52.0000" Latitude 39° 49´ 57.0000" (Coordinates from USGS Topographic Map). The Department of Environmental Protection is seeking information on private surface water intakes for human consumption located in the above listed receiving streams and located down stream of this operation. Please provide your name, phone number, mailing address, the name of the stream with the intake, and the physical location of the intake. This information needs to be submitted to the address below. An anti-degradation review has been conducted. Tier 1 protection is afforded because effluent limitations ensure compliance with water quality criteria for all designated uses. Where applicable, a full Tier 2 anti-degradation review has been conducted. Please send any comments on the draft permit to the address below, postmarked on or before November 1, 2019 or thirty days from the date of publication, and reference the Article 11/WVNPDES permit number shown above. A copy of the application, draft permit and fact sheet (if required) will be available for inspection and obtaining copies during normal business hours at the DEP Regional Office located at the address below. Comments may include a request for a public hearing. If a hearing is requested the comment must state the nature of the issues proposed to be raised in the hearing. A hearing may be held if DEP finds a significant degree of public interest, or if the hearing would clarify issues.
