WATER POLLUTION CONTROL PERMIT

The following has applied for a WV NPDES Water Pollution Control Permit for 
this facility or activity:

Activity:	
To operate and maintain an existing combined sewer collection system.  To 
operate and maintain disposal systems, best management practices, and the nine 
(9) minimum controls for the direct discharge of sanitary wastewater and storm 
water from Combined Sewer Overflow (CSO) Outlet No. C001 and CSO Outlet No. 
C002 to the Ohio River at Milepoints 316.1 and 315.4 respectively and CSO 
Outlet No. C003 to the Big Sandy River at approximately 1.1 mile to the outh of 
the Ohio River.  These CSO outlets are permitted to discharge only when the 
hydraulic capacity of the collection system is exceeded during wet weather 
events.   The collection system is designed to serve approximately 3,500 person 
equivalents in the City of Kenova and environs, and conveys wastewater to the 
jointly-owned portions of the wastewater collection system with the Town of 
Ceredo and the Northern Wayne County Public Service District, and then to the 
wastewater collection and treatment system owned and operated by the City of 
Huntington for ultimate treatment and discharge to the Ohio River.  An 
antidegradation review has been conducted.  Tier 1 protection shall be afforded 
for the discharges from CSO outfalls C001, C002 and C003 through the 
implementation of the City's site-specific CSO Long-Term Control Plan.

Compliance with the Combined Sewer Overflow requirements of the permit shall be 
attained in accordance with the provisions of Administrativw Order No. 6719, 
issued July 29, 2009 and Administrative Consent Order No, 8201, effective June 
24, 2015.

	On the basis of review of the application, the "Water Pollution 
Control Act (Chapter 22, Article 11-8(a))," and the "West Virginia Legislative 
Rules," the State of West Virginia will act on the above application.

	Any interested person may submit written comments on the draft permit 
and may request a public hearing by addressing such to the Director of the 
Division of Water and Waste Management within 30 days of the date of the public 
notice.  Such comments or requests should be addressed to:

	The public comment period begins April 22, 2020 and ends May 22, 2020.

	Comments received within this period will be considered prior to 
acting on the permit application.  Correspondence should include the name, 
address and the telephone number of the writer and a concise statement of the 
nature of the issues raised.  The Director shall hold a public hearing whenever 
a finding is made, on the basis of requests, that there is a significant degree 
of public interest on issues relevant to the Draft Permit(s).  Interested 
persons may contact the public information office to obtain further information.

	The application, draft permit and any required fact sheet may be 
inspected, by appointment, at the Division of Water and Waste Management, at 
601 57th Street SE, Charleston, WV 25304-2345, between 8:00 a.m. and 4:00 p.m. 
on business days.
