APPLICATION FOR WEST VIRGINIA SOLID WASTE FACILITY PERMIT MAJOR MODIFICATION TO 
NATIONAL POLLUTANT DISCHARGE ELIMINATION SYSTEM (NPDES) PERMIT

The following has applied to the West Virginia Department of Environmental 
Protection for a modification of a National Pollutant Discharge Elimination 
System permit:

Applicant: West Virginia Solid Waste Management Board

Application no.:	SWC-1007/WV0109045

Activity:	 Closure related activity only

The Monongalia County Landfill is closed and does not receive any waste.

The facility is located along an unnamed tributary of Little Indian Creek.  The 
center on the site is 39º 35’ 52” N latitude and 80º 04’ 03” W longitude.  The 
storm water discharge point is 39º 25’ 45” N latitude and 80º 04’ 45” W 
longitude.  All leachate will be collected and trucked to the City of 
Morgantown’s Waste Water Treatment Plant or alternate facility, if for any 
reason the City cannot accept the leachate.

On the basis of review of the application, the Solid Waste Management Act, 
Chapter 22, Article 15, Sections 5(b) and 5(c); and the West Virginia Solid 
Waste Management Rule 33CSR1, the state of West Virginia will act on the above 
application.
	
Interested persons may submit written comments during the 30-day public comment 
period, which begins on May 8, 2020 and ends on June 8, 2020 to the following

Comments received within this time period will be considered prior to any state 
action on the subject application.  Correspondence should include the name, 
address, and telephone number of the writer and a concise statement of the 
nature of the issues addressed.

The draft permit will be on file for public review during the comment period at 
the DEP regional office located at 2031 Pleasant Valley Road, Fairmont, WV  
26554, (304) 368-3950, Monday through Friday.  To receive a copy of the permit

A public hearing may be held if the state identifies a significant degree of 
public interest on issues relevant to the permit application. To obtain further 
information concerning the subject application or to request a public hearing,

comment period at the above address.
