APPLICATION FOR A CLASS 5 UNDERGROUND INJECTION CONTROL PERMIT

The following has applied for a Class 5 Underground Injection Control Permit for 
this facility or activity:

Facility:  The Marion County Mine

Latitude 39:38:29     Longitude 80:21:20

Business conducted: Coal Mining, preparation and reclamation

Activity:  Reissuance of an Underground Injection Control Permit to continue 
injecting AMD treatment sludge into 4 (four)
Class 5, Type 5x13 injection wells into the Marion County Mine in the Pittsburgh 
coal seam and internal transfer of Marion County Mine water through 2 (two) Class 5, 
Type 5G30 injection wells in Marion and Monongalia Counties.  The State of West 
Virginia will act on the above application in accordance with the West Virginia 
Legislative Rules, Title 47, Series 13, Section 13.24 issued pursuant to Chapter 22, 
Article 11 and Article 12.

Any interested person may submit written comments on the draft permit and may 
request a public hearing in writing within thirty (30) days of the date of this
